Abstract: The information collected by HUD is used to issue refunds to depositors where labor standards discrepancies have been resolved, and to issue wage restitution payments on behalf of construction and maintenance workers who have been underpaid for work performed on HUD-assisted projects subject to prevailing wage requirements.

Emergency Justfication: This request is essential since the payments represent funds to which the payee is entitled under various Federal laws, including the Davis-Bacon and Related Acts, supporting HUD programs. These payments are often substantial and represent refunds of amounts deposited to guarantee the statisfaction of Federal labor standards requirements which have since been resolved, and wage restitution to construction and maintenance workers for income earned many years prior on HUD-assisted projects. This emergency ICR includes a new HUD form that will collect banking information to allow underpaid workers to have the option of direct deposit.

Short Statement: This is a new collection. In order to make refunds and wage restitution payments, HUD would verify the identity of the payee to ensure that the refund was made to the correct depositor or to the correct worker before the check was issued. A new form has been developed which allows the option for direct deposit. Banking information needs to be collected for this process.
