The agency must make a stronger justification for the information collection. The agency must explain how an event so rare can have utility in fulfilling the purposes of the Biological Opinion and how the agency will use information about this rare event to protect the species.

This information is necessary to comply with the terms and conditions set forth in the incidental take statement section of a biological opinion issued by the U.S. Fish and Wildlife Service (USFWS) regarding the implementation of Amendment 11 to the Coastal Pelagic Species Fishery Management Plan (CPS FMP) and its effects on the federally endangered southern sea otter. Pacific sardine fishermen will be required to report interactions with southern sea otters and the information gathered from these reports will be used by National Marine Fisheries Service (NMFS) and USFWS to determine whether further measures will need to be implemented to ensure the continued protection of the southern sea otter.
