and new amendment forms (DSP-6, DSP-62, DSP-74, and DSP-84)

DSP-6 – “Application for Amendment of a DSP-5 License, Permanent Export of Unclassified Defense Articles and Related Unclassified Technical Data”


DSP-62 – “Application for Amendment of a DSP-61 License, Temporary Import of Unclassified Defense Articles”


DSP-74 – “Application for Amendment of a DSP-73 License, Temporary Export of Unclassified Defense Articles”


DSP-84 – “Application for Amendment of a DSP-85 License, Permanent/Temporary Export or Temporary Import of Classified Defense Articles and Related Classified Technical Data”



The DSP-119 is an amendment form currently used in paper format and electronic submission on ELLIE to amend the DSP-5, DSP-61, DSP-73, and DSP-85. The DSP-119 was used to amend:

1) addition of a U.S. freight forwarder

a) also referred to as U.S. consignee and U.S. consignor;

2) addition of a U.S. consignor;

a) also referred to as U.S. forwarder

3) change due to an obvious typographical error;

a) change in commodity due to legitimate change in part number or obvious typographical error

  1. correction to quantity only when error was made on the original

submission,

c) correction to dollar value only when error was made on the original

submission which will result in change to total dollar value

4) change in source of commodity;

5) change of foreign intermediate consignee if that party is only transporting the equipment and will not process (e.g., integrate, modify) the equipment;

6) change due to a merger, acquisition, name change, or change in location

7) change to original PM/DDTC Registrant Code

8) change in original applicant/subsidiary due to name change or change in address

9) change in manufacturer of commodity

10) for DSP-6, DSP-62, DSP-74, change in name, address, and /or city of original foreign consignee, can’t be result of a merger or acquisition

11) for DSP-6, DSP-74, change in name, address, city, state, and/or ZIP code of original U.S. seller, can’t be a new U.S. seller

12) for DSP-6, DSP-74, change in foreign intermediate consignee also referred to as change in foreign freight forwarder

13) for DSP-6, change in U.S. consignee and/or U.S. freight forwarder

14) for DSP-62, change in original foreign consignor

15) for DSP-62, change in foreign intermediate consignee

16) for DSP-62, change in U.S. intermediate consignee

17) for DSP-62, change in original foreign owner/end-user

18) for DSP-74, change in temporary foreign consignee

19) for DSP-74, change in original temporary foreign end-user

20) for DSP-74, change in Aircraft/Vessel commander

21) for DSP-84, change in cognizant DSS security office

DSP-119 equivalent of “Applicant’s Statement” in DSP-6, DSP-62, DSP-74, and DSP-84:

-22 CFR 120.25 empowered official certification

-22 CFR 126.13 certification

-U.S. person or official of foreign government certification

-22 CFR 130 statement had to be submitted as an attached letter

all of above are incorporated in “Applicant’s Statement” in DSP-6, DSP-62, DSP-74, and DSP-84.


The DSP-6, DSP-62, DSP-74, and DSP-84 directly ask the question is this amendment in accordance with 22 CFR 123.25 which is in the International Traffic in Arms Regulations (ITAR) and entitled “Amendments to licenses.” Thus, when using the DSP-119 the applicable ITAR cite is 22 CFR 123.25. That portion of the form is not new.








The DSP-6, DSP-62, DSP-74, and DSP-84 directly ask the question is this amendment in accordance with 22 CFR 122.4 which is in the ITAR and entitled “Notification of changes in information furnished by registrants.” By practice the DSP-119 has been used for changes due to mergers, acquisitions or name changes. Therefore, this portion of the form is not new. The form just explicitly clarifies this type of change.


The DSP-6, DSP-62, DSP-74, and DSP-84 directly ask for “Provide the Compliance Case Number” and “Provide the date of PM/DTCC Acknowledgment Letter.” These are requirements under 22 CFR 122.4 when there is a name change or change in address of the original applicant/subsidiary on the license which runs in parallel to the same information being changed in the “Statement of Registration” (Form DS-2032, OMB Approval No. 1405-0002, Expiration Date 09/30/2008) due to name change or change in address. By practice the DSP-119 has been used for changes due to mergers, acquisitions or name changes. The form just explicitly clarifies this type of change.
