The proposed rule establishes
procedures for the submission of an application from an Indian
tribe seeking a Secretarial determination that a gaming
establishment on land acquired in trust after October 17, 1988, and
not exempt under one of the other statutory exemptions to the
prohibition on gaming contained in Section 20 of IGRA, would be in
the best interest of the Indian tribe and its members, and would
not be detrimental to the surrounding community.
