A. Justification


1. Form CBP-4315, "Application for Allowance in Duties," is required by the CBP in instances of claims of damaged or defective merchandise on which an allowance in duty is made in the liquidation of the entry, as required by sections of 19 CFR 158.


2. The information is used to substantiate importers claims for such duty allowances. If the information is not collected, the claimant might not be able to demonstrate eligibility for such an allowance.


3. It is not appropriate for this form to be submitted electronically because it is used on the docks or warehouse to document, inventory and determine the disposition of damaged merchandise coming into the country. There are many signature blocks and an actual physical exam is conducted. There are three places for a CBP Officer to sign for inspection, disposal, destruction or to identify that the material has no commercial value. The signatures need to be made at different times and locations during the importation. Because of this, a physical form would be more efficient than an electronic form.


4. Since each application is unique, this information is not duplicated.


5. All companies, regardless of size, must submit this documentation to receive an allowance in duties.


6. There is no benefit to the Federal program or policy if this information is not collected. It is to the benefit of private companies to submit this information to obtain an allowance in duties.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.6.


8. Public comments were solicited through two Federal Register notices dated, August 17, 2006 and October 19, 2006. As of this submission no comments have been received.


9. There is no offer of a monetary or material value for this information collection.


10. No assurances of confidentiality are given with this information collection.


11. There are no questions of a personal or sensitive nature.

12. Estimated Annualized Burden on The Public The estimated burden for this information collection is 1,600 hours. This is based on an estimated 12,000 respondents who average 1 response each for a total of 12,000 responses. Each response is estimated to require .1333 hour (8 minutes) for a total burden of 1,600 hours.


Estimated Annualized Cost on the Public. The estimated cost to the respondents is $29,000.00. This is based on an estimated 1,600 burden hours at a rate of $18.15 per hour.


13. Estimated Record Keeping Burden on the Public. There is no record keeping burden requirement for this information collection.


Estimated Capitalization Cost Burden on the Public. There are no capitalization cost associated with this collection.


14. Estimated Annualized Cost to the Federal Government. The estimated cost to the Federal Government associated with collecting, analyzing and processing information is $60,900. This is based on an estimated 2,030 hours expended at an average hourly rate of $30.00.


15. There are no changes to this information collection.


16. This information collection will not be published for statistical purposes.


17. We will put the expiration date on the form when we receive a Notice of Action from OMB with the new date.
