A. Justification


1. A port director decides when his port needs one or more Centralized Examination Stations (CES). He announces this need and solicits applications to operate a CES. The information contained in the application will be used to determine the suitability of the applicant's facility, the fairness of fee structure, knowledge of cargo handling operations and of Customs and Border Protection (CBP) procedures. The names of all corporate officers and all employees who will come in contact with uncleared cargo will also be provided so that CBP may perform background investigations. 19 CFR 118.11 requires these applications.


2. The applications for CES's are submitted to the port director for review. The port will review each package, visit each site, and make a selection. The purpose is to choose the operation that can best handle containerized cargo for examination.


3. The CBP regulations require that this information be submitted manually. The information in this collection will be eventually collected electronically utilizing the Automated Commercial Environment (ACE), which is under development. It is anticipated that this will take effect in 2011.


4. The information on each application is unique, this information is not duplicated.


5. No additional consideration has been given to small businesses or entities.


6. This information is completed only once and cannot be collected less frequently. If this information were not collected, this program could not be continued.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.6.


8. Public comments were solicited through two Federal Register notices dated September 18, 2006 and November 24, 2006. As of this submission no comments have been received.

12. Estimated Annualized Burden on The Public is 100 hours. This is based on an estimated 50 respondents who average one response each for a total of 50 responses. Each response is estimated to require 2 hours (120 minutes) for a total burden of 100 hours.


Estimated Annualized Cost on the Public. The estimated cost to the respondents is $1,450.00. This is based on an estimated 100 burden hours at a rate of $14.50 per hour


13. Estimated Record Keeping Burden on the Public. There is no record keeping burden requirement for this information collection.


Estimated Capitalization Cost Burden on the Public. There is no capitalization cost associated with this collection.


14. The Estimated Cost to the Federal Government for this information collection is $3,300. This is based on an estimated 110 hours expended at an average hourly rate of $30.00.


15. There are no changes to this information collection.


16. This information collection will not be published for statistical purposes.


17. There is no form associated with this information collection.
