OMB approves this emergency collection (associated with the 9/11 interim final regulations) for six months only. The burden estimate for this collection represents what ED believes to be the total number of individuals who may qualify for the September 11, 2001 Survivors loan discharge (1,000 respondents), rather than the annual number of respondents who are expected to apply. This submission requests the full number of respondents because ED expects that most eligible individuals will apply during the first year. ED will report the appropriate adjustments to the burden in future submissions for OMB approval.

This loan discharge application form is the means by which certain survivors of victims of the September 11, 2001 terrorist attacks may apply for a discharge of their FFEL, Perkins, or Direct Loan Program federal student loans.
The Department of Education is required to develop procedures for borrowers to file applications for this new loan discharge benefit under implementing regulations that must be published within 90 days after the date of enactment of the Third Higher Education Extension Act (no later than December 29, 2006). As part of the application process, we have develop the attached form to enable borrowers to apply for this new benefit. The form will collect the information needed to establish a borrower's eligibility for the discharge. So that eligible borrowers will have a means of applying for the new loan discharge benefit as soon as possible after publication of the implementing regulations. We will also submit this forms clearance package through the regular 120-day review process in order to received a three-year approval for the form.
