The following e-mail was received from EPA on January 16, 2008.
"The purpose of this email is confirm that EPA is withdrawing the Chlorine and Chlorinated Hydrocarbon (CCH) Manufacturing Segment Information Collection Request (ICR) based on the understanding that EPA may resubmit this request without further work or another 60-day FR notice. In the meantime, the CCH industry has committed to do an extensive, year long monitoring program so that EPA and the industry can better characterize the dioxin discharges. Upon completion of the monitoring program, EPA will evaluate the need for a rulemaking and an ICR."
EPA understands that resubmitting the ICR would require a concurrent 30-day notice in the Federal Register to inform the public that the ICR is once again under OMB review and to provide a fianl opportunity for comment to OMB.

The Clean Water Act directs EPA to develop national technology-based regulations placing limits on the pollutants that are discharged by categories of industry to surface waters (termed "effluent guidelines") or to sewage treatment plants (termed "pretreatment standards"). The Act also directs EPA to develop national technology-based regulations (termed "new source performance standards") for new industrial facilities.
The 2004 Effluent Guidelines Program Plan (69 FR 53705) identified facilities in the Chlorine and Chlorinated Hydrocarbon (CCH) Manufacturing Segments for possible revision because these manufacturing operations discharge significant quantities of toxic pollutants. EPA's Office of Water will determine if revised regulations are required for facilities in the CCH manufacturing segments. Currently, wastewater from some CCH manufacturing is regulated by the Organic Chemicals, Plastics, and Synthetic Fibers (OCPSF) Point Source Category (40 CFR Part 414), and wastewater from most chlorine manufacturing is regulated by the Inorganic Chemicals Manufacturing Point Source Category (40 CFR Part 415). EPA will propose amendments to both Parts 414 and 415, as appropriate. Chlorinated hydrocarbons that are regulated under the Pharmaceutical Manufacturing (40 CFR Part 439) or Pesticide Chemicals (40 CFR Part 455) Point Source Categories are excluded from this effort.
EPA will collect information from all chemical companies in the CCH manufacturing segments using a questionnaire. The Agency will use the questionnaire responses to support the possible revision of effluent guidelines and pretreatment standards for the CCH manufacturing segments.
