21 U.S.C. § 826 and 21 CFR §§ 1303.12 and 1315.32 require that U.S. companies who desire to use any basic class of controlled substances listed in Schedule I or II or the List I chemicals ephedrine, pseudoephedrine, and phenylpropanolamine for purposes of manufacturing during the next calendar year shall apply on DEA Form 250 for procurement quota for such class or List I chemical.
The Drug Enforcement Administration (DEA) is requesting emergency processing of the revision of Office of Management and Budget (OMB) information collection 1117-0008 “Application for Procurement Quota for Controlled Substances and Ephedrine, Pseudoephedrine, and Phenylpropanolamine,”. The revision of this information collections is associated with, and essential for the implementation of, the DEA Interim Rule with Request for comment entitled “Import and Production Quotas for Certain List I Chemicals” [Docket No. DEA-293, RIN 1117-AB08].

The Combat Methamphetmaine Epidemic Act of 2005 (Title VII of Pub. L. 109-177) amended the Controlled Substances Act (21 U.S.C. 826) to require the establishment of production quotas for the List I chemicals ephedrine, pseudoephedrine, and phenylpropanolamine. An additional 240 firms will need to apply for individual procurement quotas to comply with the Controlled Substances Act as amended. The 240 hour annual burden increase is a result of this statutory change.
