OMB notes that DHS' current collection of information for purposes of registering facilities for future use of the CSAT has not yet been approved by OMB, and is thus a PRA violation that will be reported in next year's Information Collection Budget.

The Chemical Security Assessment Tool (CSAT) is the Department of Homeland Security's system that will collect and analyze key data from chemical facilities under Section 550 of P.L. 109-295 to: (1) Identify the high-risk chemical facilities covered under the regulation, (2) Support the facility specific judgment for preliminary and final tier determinations, (3) Specify the facility specific security concerns that must be addressed in the SVA and SSP, and (4) Collect the facility specific security measures, activities, and systems for judging compliance against the Risk Based Performance Standards (RBPS).
In order to comply with the regulations set forth in the FY07 DHS Appropriations Bill, Information must begin to be collected April 4, 2007. DHS must vet all users requesting access into the CSAT program and this could take up to 60 days to get everyone through the system. DHS would also like to give users as long as possible to complete the Top Screen portion of the system. If facilities are not able to comply with regulations and register in time and do the top screen; they could be fined up to $25,000 a day.

New regulations gave DHS the authority and responsibility to collect information from all chemical facilities across the country. DHS must understand how each facility operates so that the facility can be placed into a tier. Once the tier has been established, DHS can deterime if the appropriate security and risk mitigation documentation is appropriate. The same 40,000 people will be completing the User Registration and the Top Screen portions. Hence there are two responses per each of 40,000 individuals resulting in 80,000 responses. The burden hour submitted in ROCIS is the average time it takes to complete the Top Screen 30.5 hours thus resulting in an estimated burden of 1,222,000. The burden for all levels of respondents is 1,222,750.5 hours as shown in the Supporting Statement.
