Distribution of Continued Dumping and Subsidy Offset to Affected Domestic Producers

A. Justification


1. The collection of information is required to implement the Continued Dumping and Subsidy Offset Act of 2000 (19 U.S.C. 1675c). This Act prescribes the administrative procedures, including the time and manner, under which antidumping and countervailing duties assessed on imported products would be distributed to affected domestic producers that petitioned for or supported the issuance of the order or finding under which the duties were assessed. The amount of any distribution afforded to these domestic producers is based upon certain qualifying expenditures that they incur after the issuance of the order or finding. This distribution is known as the continued dumping and subsidy offset and is found in the CBP regulations under 19 CFR 159.63.


2. The information is to be used by Bureau of Customs and Border Protection (CBP) officers to validate claims filed under the Continued Dumping and Subsidy Offset Act of 2000.


3. This collection may be filed electronically using the internet site pay.gov.


4. Since each notice is unique, this information is not duplicated elsewhere.


5. This collection of information does not significantly impact small businesses or entities.


6. Failure to collect this information would prevent CBP from determining the extent of claims from affected domestic producers that petitioned for or supported the issuance of the order or finding under which the duties were assessed.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.5(c)(2).


8. Public comments were solicited through two Federal Register notices published on February 15, 2007 and on April 18, 2007. As of this submission no comments have been received.


9. There is no offer of a monetary or material value for this information collection.

10. This information collection may involve questions of a commercially sensitive nature. The information collected is kept confidential and stored in a secure location with access granted only to CBP officers with an official “need to know”.


11. There are no questions of a personal or sensitive nature on this declaration.


12. Estimated Annualized Burden on the Public - The burden for this information collection is 2,000 hours, based on an estimated 2,000 respondents filing an estimated 1 response each year for a total of 1 annual response. Each response requires an estimated 1 hour (60 minutes) to complete.


Estimated Annualized Cost to the Public. The estimated cost to public is $60,000. This is based up on 2,000 burden hours at an estimated $30.00 per hour.


13. Estimated Record Keeping Burden on the Public. There is no record keeping burden associated with this collection.


Estimated Capitalization Cost Burden on the Public. There are no capitalization cost associated with this information collection.


  1. Estimated Cost to the Federal Government - The estimated annual cost to the Federal Government in handling, processing and recording the information is estimated at $250,000. This is based on 2,000 claims x 4 hours/claim processing time x $31.25/hour = $250,000.
