Under 29 USC 1002(37)(G), as amended by section 1106 of the Pension Protection Act of 2006, Pub.L. 109-280, eligible single-employer plans may elect to be multiemployer plans pursuant to election procedures prescribed by PBGC. The procedures prescribe information PBGC needs to determine whether the eligibility requirements in 29 USC 1002(37)(G) have been met and whether a plan’s election should accordingly be approved. Information and representations made in submissions will be retained for audit purposes.
