This information collection is being collected to determine the scope and circumstances of USAID's contracting and grant arrangements with private security firms.
Emergency Processing Determination Mr. Kunder, the Acting Assistant Administrator for USAID, has directed the Office of Acquisition and Assistance (“OAA”) to gather information concerning the terms and scope of USAID’s grants and contracts with security service providers at USAID missions worldwide. Pursuant to 5 CFR 1320.13, I hereby determine that: 1. The USAID Security Firm Survey must be initiated prior to the expiration of the 30-day notice period (after publication in the Federal Register) and the standard 60-day OMB approval period established by 5 CFR 1320.10. The minimum two to three-month delay entailed in OMB’s normal approval process would cause serious disruption in gathering information regarding the grants and contacts USAID has executed with private security firms and how these firms have performed, as outlined below. 2. Collection of this information is necessary because of the unanticipated event involving the use of deadly force by U.S. Government contractors and/or subcontractors or subgrantees in Iraq. There is now a tremendous amount of interest in how, when and where the Government is using private security firms. This interest has been heightened in recent weeks due to the media coverage and Government investigation of Blackwater’s actions in Iraq. Further, one of USAID’s subcontractors in Iraq was recently involved in a deadly force incident, bringing potential scrutiny to USAID over how it establishes a secure environment for its employees. 3. USAID cannot reasonably comply with the normal clearance procedures under this part because USAID must analyze the clauses in its grants/contracts with security firms, understand the incidents the firms have been confronted with, and prepare to answer questions the U.S. Government will have for USAID in light of the recent heightened interest and scrutiny.
