Terms of Clearance: This information collection request is not approved. First, the agency has not sufficiently justified emergency processing under 5 CFR 1320.13. Second, the forms need to be revised to avoid the confusion that is caused a lack of instructions on the form and a lack of contact information for the agency. If the forms are to be submitted only to third parties, then the forms should be very clear in this regard. Third, the program should be clearly designated as a pilot program, limited in scope and scale, and subject to programmatic reevaluation prior to expansion. Fourth, the form design should not be dictated by form length; the density of information required by the form make both completion and reading of the information difficult and prone to error. The agency should resubmit this package for regular processing, under the currently pending 60-day notice, after revisions in accordance with these Terms of Clearance.

Abstract: The information collected through these forms from the small business applicants and participating lenders will be used to determine eligibility and to properly evaluate and consider the merits of each loan request based on such criteria as character, capacity, credit, collateral, etc. for the purpose of extending credit under the 7(a) loan program

Emergency Justfication: SBA is request that the forms for a new 7(a) loan initiative, Lender Advantage, be reviewed and approved on an emergency basis. Your approval of this request would facilitate SBA's implementation of this new initiative that the Agency intended to implement by the end of October, 2007. (Please reference justification letter to David Rostker dated October 16, 2007)
