This collection is being returned to DHS as improperly submitted. The collection request should be resubmitted for approval through the regular process.
The justification for this emergency request is based solely on the upcoming statutory deadline of August 3rd, 2008. According to the emergency justification, TSA will need 9 months to collect and process these data in order to meet the requirements of the statute. Therefore, it isn't possible for TSA to meet the deadline even with emergency PRA approval. Further, the 9/11 bill was signed in August of 2007, giving TSA plenty of time to publish their FR notices and seek OMB approval through regular procedures.
Public comment improves the quality of collections of information. By following the standard process TSA's collection instrument will be better able to capture the data that provides the greatest practical utility and imposes the least burden on respondents.

TSA plans to request critical facility and annual product through-put information from owners and operators of the nations largest pipeline sytems in order to comply with the requirments set fourth in Section 1557 (b) of the Implementing the Recommendations of the 9/11 Commission Act of 2007, P.L. 110-53 (2007) (9/11 Act. Pipeline owners and operators will be able to transmit the information via electronic mail. The information will be protected in accordance with e applicable information protection laws and regulations.
TSA Seeks emergency processing and approval for its request of top 125 pipleine systems owners to provide a listing of their critical facilities. This information is essential to the mission of TSA in order to meet the requirements of the 9/11 Commission Act of 2007 which tasks TSA to develop a pipeline security and incident and recovery protocals plan.
