Establishment of a Container Station

A. Justification


1. A container station that is independent of either an importing carrier or a bonded carrier may be established at any port or portion thereof which is under the jurisdiction of a port director. The container station is used for the unloading of containers that contain imported merchandise pursuant to the requirements of 19 CFR 19.40.


2. The container station operator must file an application to establish the container station. The applicant must also file a bond with the port director in the amount of $25,000 or such larger amount that is determined by the port director. Not all of the applications are approved. If the Bureau of Customs and Border Protection (CBP) did not collect the information, the procedure for the establishment of a container station would be impossible to initiate, and consequently the reporting costs would increase to the public and the government.


3. CBP plans to automate this collection of information in the new Automated Commercial Environment (ACE) by 2012.


4. This information is not collected in any other place or in any other form. The information provided for each submission is unique and is only provided on this form. Therefore, identical information will never be available elsewhere.


5. No special consideration is given for small businesses or entities. If someone wants to establish a container station, the same information must be filed regardless of size.


6. This is a one time collection; therefore, it cannot be collected less frequently and still receive the information on container stations.


  1. This information collection is conducted in a manner consistent with the guidelines of 5 CFR 1320.5(c).


8. Public comments were solicited through two Federal Register notices published on March 4, 2008 (Volume 73, Page 11656) and on May 6, 2008 (Volume 73, Page 25024). As of this submission no comments have been received.


9. There is no offer of a monetary or material value associated with this information collection.


10. No assurances of confidentiality are given, and no confidential information required by this collection.

12. Estimated Annualized Burden on the Public - The estimated annual reporting burden for this collection is 615 hours. This is based on 205 responses annually, each response requires an estimated 3 hours.

Estimated Annualized Cost to the Public - The estimated costs to the respondents is $8917.50, based on 615 burden hours at an average hourly rate of $14.50.


13. Estimated Record keeping Burden on the Public. There is no recordkeeping burden hours associated with this information collection.


Estimated Annualized Capitalization Cost Burden to the Public. There are no capitalization costs associated with this information collection.


14. Estimated Cost to the Federal Government.

The estimated annual cost associated with the collection and processing of the application is $7,000. This is based on 200 hours expended at an average hourly rate of $35.00.


15. There are no changes to this information collection.


16. This information collection will not be published for statistical purposes.


17. This collection does not involve a form so there is no printed expiration date.


18. There are no exceptions to the certification statements identified in Item 19 on the 83-i.
