Abstract: DFARS clause 252.225-7009 requires a report on the types of commercially available off-the-shelf its containing specialty metals that are incorporated in non-commercial end items purchased by DoD in and of the 6 major product categories (i.e., aircraft, missile and space systems, ships, tank and automotive, weapon systems, or ammunition). DFARS clause 252.225-7010 requires an offeror to certify that it will take certain actions if the offeror chooses to use the alternative compliance approach when providing commercial derivative military articles to the Government.

Emergency Justfication: This emergency submission is necessary and appropriate to implement section 804 of Public Law 110-181. Section 804 requires implementation within 120 days of enactment on January 28, 2008 (May 27, 2008). A DFARS Interim Final Rule will be published.
