Abstract: The Merit Systems Protection Board (MSPB) is requesting approval from the Office of Management and Budget (OMB) to conduct Federal employee surveys for a period of two years from the approval date on the subject of management activities related to disciplinary and adverse actions. Section 1204 of Title 5, U.S. Code, authorizes the MSPB to perform special studies related to the civil service and other merit systems in the executive branch. The fair and appropriate use of disciplinary and adverse actions to effectively manage the Federal workforce is a key component of a merit based civil service. The survey conducted under this OMB authorization will obtain information from proposing and deciding officials regarding their use of current laws and regulations to achieve the twin goals of ensuring appropriate actions are taken effectively, and that employees receive all procedural rights due to them under the law and applicable regulations.

Short Statement: One of the MSPB’s ongoing statutory functions is to “conduct, from time to time, special studies relating to the civil service and to other merit systems in the executive branch, and report to the President and to the Congress as to whether the public interest in a civil service free of prohibited personnel practices is being adequately protected.” 5 U.S.C. 1204(a)(3). This information collection is part of that effort. As a new information collection, it obviously increases the net burden of the MSPB’s information collections.
