Permit to Transfer Containers to a Container Station

A. Justification
1. Once a person is granted a permit to operate a container station, the port director may demand a list of names, addresses, social security numbers, and dates and places of birth of the persons employed by him. This list must be furnished within 30 calendar days after the date of receipt of a written demand by the port director. The movement of containers into and out of the container station will not be allowed until the list is provided. Also, no new permit will be issued if the operator fails to notify Bureau of Customs and Border Protection (CBP) within 10 calendar days after the employment of any new personnel who will be involved with the movement, receipt, storage, or delivery of imported merchandise, and fails to provide the names, addresses, etc. of the new personnel. The operator must also notify the port director within 10 calendar days of the termination of employment of an employee pursuant to 19 CFR 19.46.
2. Once the permit has been issued, the operator of the container station is to provide a list of the names, addresses, social security numbers, etc. of all employees. This also includes notification of new employees or the termination of employment of any employee. If the information were not collected CBP would have no way of completing background checks. This would compromise the CBP Service's responsibility for enforcing adequate cargo security.
3. Currently this information is faxed to CBP local port offices, however electronic submission of the information is planned for the Automated Commercial Environment (ACE) by 2012.
4. This information is not collected in any other place or in any other form. The information provided for each submission is unique and only provided in this information collection and is not duplicated elsewhere.
5. No special consideration has been given to small businesses or entities.
6. If the information was collected less frequently, CBP could not conduct timely background investigations on the employees. The information collection also helps in the timely identification of previous problems with other companies or employees.
7. This information is conducted in a manner consistent with the guidelines of
5 CFR 1320.5(c)(2).
8. Public comments were solicited through two Federal Register Notices published on March 25, 2008 (Volume 73, Page 15765) and on June 10, 2008 (Volume 73, Page 32726). As of this submission, no comments have been received.

10. All sensitive information will be stored in a secure location.
11. The social security numbers are needed to identify the employees.
12. Estimated Annualized Burden on the Public - The estimated burden for this information collection is 466 hours. This is based on an estimated 350 respondents who average 4 responses per year for a total of 1,400 responses. Each response is estimated to take approximately 0.333 hours (20 minutes to complete).
Estimated Annualized Cost to the Public - The estimated cost associated with this collection is $11,160.00, based on 466 burden hours at an average estimated cost of $23.95 per hour.

Estimated Cost to the Federal Government associated with collecting, analyzing and processing the information is $49,735. This is based upon an estimated 1,421 hours expended at an average hourly rate of $35.00.
