Under Various Special Tariff Treatment Provisions

A. Justification


1. Explain the circumstances that make the collection of information necessary. Identify any legal or administrative requirements that necessitate the collection. Attach a copy of the appropriate section of each statue and regulation mandating or authorizing the collection of information.


U.S. made articles which are returned without having been advanced in value or improved in condition abroad, and photographic films and dry plates of U.S. origin which are exposed abroad and returned are eligible for duty-free entry under subheadings 9801.00.10 and 9802.00.20, Harmonized Tariff Schedules of the United States (HTSUS), respectively. Articles which are exported for repairs or alterations and returned, and U.S. produced metal articles which are exported for further processing and returned for further processing are eligible for a partial duty exemption under subheadings 9802.00.40, 9802.00.50 and 9802.00.60, HTSUS, respectively. U.S. Notes 1(a) and (c) to subchapter 1, Chapter 98, HTSUS. The declaration by the owner, importer, consignee or agent required by 19 CFR 10.1(a), 10.8(a) and 10.9(a) states that these conditions have been met.


2. Indicate how, by whom, and for what purpose the information is to be used. Except for a new collection, indicate the actual use the agency has made of the information received from the current collection.


The port director of Customs and Border Protection (CBP) is responsible for determining whether imported articles are entitled to duty-free or reduced treatment under subheadings 9801.00.10, 9802.00.20, 9802.00.40, 9802.00.50, and 9802.00.60, HTSUS. The declarations are to be filed upon entry of such articles to enable an import specialist and the port director to ascertain whether the statutory conditions and requirements of these provisions have been satisfied.


3. Describe whether, and to what extent, the collection of information involves the use of automated, electronic, mechanical, or other technological collection techniques or other forms of information technology, e.g. permitting electronic submission of responses, and the basis for the decision for adopting this means of collection. Also describe any consideration of using information technology to reduce burden.


Electronic submission of this information is planned as part of CBP’s Automated Commercial Environment by 2012.


4. Describe efforts to identify duplication. Show specifically why any similar information already available cannot be used or modified for use for the purposes described in Item 2 above.


The information reported on each declaration is unique and is, therefore, not duplicated elsewhere.


5. If the collection of information impacts small businesses or other small entities describe any methods used to minimize burden.


This collection of information does not have a significant impact on small businesses or other entities.


6. Describe consequences to Federal program or policy activities if the collection is not conducted or is conducted less frequently.


Since the information is unique for each submission, this information is only submitted once. If this information was not collected, CBP could not comply with its statutory and regulatory requirements.


7. Explain any special circumstances that would cause an information collection to be conducted in a manner:


This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.5(c)(2).


8. If applicable, provide a copy and identify the date and page number of publication in the Federal Register of the agency's notice, required by 5 CFR 1320.8(d), soliciting comments on the information collection prior to submission to OMB.


Two Federal Register Notices were published on March 25, 2008 (Volume 73, Page 15762) and on June 10, 2008 (Volume 73, Page 32727) soliciting comments from the public. As of this date, no comments have been received.


9. Explain any decision to provide any payment or gift to respondents, other than remuneration of contractors or grantees.


There is no offer of a monetary or material value for this declaration.







10. Describe any assurance of confidentiality provided to respondents and the basis for the assurance in statute, regulation, or agency policy.


No specific assurance of confidentiality is provided with this information collection.


11. Provide additional justification for any questions of a sensitive nature

The estimated cost to the respondents is $352,715. This is based on the estimated burden hours (14,575) multiplied (x) hourly rate ($24.20).

There are no recordkeeping requirements associated with this information collection.


There are no capital or start-up costs associated with this information collection. Additionally, there is no fee charge associated with the collection of this information.

The estimated cost to the Federal Government associated with collecting the information is $244,860 annually. This is calculated by the estimated hours expended (6,996) multiplied (x) hourly rate ($35.00) = $244,860.

There are no changes to this information collection.
