The quality measures data collected from eligible professionals and/or registries who submit PQRI quality measures results and numerator and denominator data on behalf of eligible professionals in 2009 and the e-prescribing quality measure data collected from eligible professionals will be used by CMS to: (1) determine whether an eligible professional meets the criteria for satisfactory reporting of quality measures data for the 2009 PQRI and/or the criteria for successful electronic prescribers for the 2009 E-Prescribing Incentive Program, (2) to calculate and make incentive payments in 2010 to eligible professionals who meet the criteria for satisfactory reporting of quality measures data and/or eligible professionals who are successful electronic prescribers, and (3) publicly post the names of eligible professionals who satisfactorily report PQRI quality measures data and/or who are successful electronic prescribers on the CMS Web site.

Subject
The Office of Clinical Standards and Quality (OCSQ) is requesting emergency approval of a new information collection for the PQRI.
Background
Section 101(b) of Division B of the Tax Relief and Health Care Act of 2006 - Medicare Improvements and Extension Act of 2006 (Pub. L. 109-432) (MIEA-TRHCA) amended section 1848 of the Social Security Act (the Act) by adding subsection (k). Section 1848(k)(1) of the Act requires the Secretary to implement a system for the reporting by eligible professionals of data on quality measures as described in section 1848(k)(2) of the Act. Section 101(c) of the MIEA TRHCA, as amended by the Medicare, Medicaid, and SCHIP Extension Act of 2007 (Pub. L. 110-173) (MMSEA), authorizes "Transitional Bonus Incentive Payments for Quality Reporting" in 2007 and 2008, for satisfactory reporting of quality data, as defined by section 101(c)(2) of the MIEA TRHCA. We have named this quality reporting system the "Physician Quality Reporting Initiative (PQRI)" for ease of reference.
The MMSEA required the Secretary to establish alternative reporting periods and alternative criteria for satisfactorily submitting data on quality measures through medical registries and for reporting groups of measures for 2008 and 2009. For 2009, section 1848(k)(2)(B)(ii) of the Act, as amended by the MMSEA, requires the Secretary to publish a proposed set of quality measures that would be appropriate for eligible professionals to use to submit data in 2009 in the Federal Register by August 15, 2008. Such measures shall be measures that have been endorsed or adopted by a consensus organization, such as the National Quality Forum (NQF) or the AQA (formerly the Ambulatory Care Quality Alliance), that include measures that have been submitted by a physician specialty, and that the Secretary identifies as having used a consensus based process for developing such measures. In addition, the measures shall include structural measures, such as the use of electronic health records (EHRs) and electronic prescribing (e-prescribing) technology. The Secretary must publish the final set of measures in the Federal Register no later than November 15, 2008 as required by section 1848(k)(2)(B)(iii) of the Act, as amended by the MMSEA.
The Medicare Improvements for Patients and Providers Act (Pub. L. 110-275) (MIPPA), which was enacted July 15, 2008, codifies the PQRI under sections 1848(k)(2) and 1848(m) of the Act and includes makes the PQRI a permanent program and, for the 2009 PQRI, authorizes us to make incentive payments for satisfactorily reporting data on quality measures. In addition, the MIPPA authorizes a new incentive program beginning in 2009 for eligible professionals who are determined to be successful electronic prescribers as defined in section 1848(m)(3)(B)(ii) of the Act.
Justification
As discussed above, section 1848(k)(2)(B)(iii) of the Act requires us to publish the final set of quality measures for the 2009 PQRI in the Federal Register no later than November 15, 2008. CMS is in the process of publishing the CY 2009 Physician Fee Schedule (PFS) final rule with comment period, which is statutorily required to be published by November 1, 2008. In addition to finalizing the 2009 PQRI quality measures and the requirements for satisfactory reporting of quality measures data for the 2009 PQRI, the CY 2009 PFS final rule with comment period also implements the MIPPA provisions with respect to the 2009 PQRI and the 2009 E-Prescribing Incentive Program.
We are requesting emergency clearance of this information collection request be approved to accommodate the statutorily mandated timeframes for finalizing the 2009 PQRI quality measures and the CY 2009 PFS regulation and to allow timely implementation of the 2009 PQRI and the 2009 E-Prescribing Incentive Program.
