The proposed regulation was written to
update the present interstate regulation that became effective more
than 20 years ago. The present regulation does not reflect passage
of major legislation and technological advancements made over the
years. There is a new requirement imposed by the proposed
regulation. Proposed section 303.7(d)(5) adds a notice requirement
where the initiating state has requested the responding state for a
controlling order determination. Since statewide Child Support
Enforcement Systems are already required, this new regulatory
requirement would be considered a minor change.
Adding one transaction to
automated system to send notice of request for determination of a
controlling order. This transaction is to happen within 10 working
days of receipt of the request or location of the noncustodial
parent, whichever come first. This will assist states in tracking
status of intergovernmental cases.
