This ICR is not approved. EPA should resubmit this ICR at the final rule stage. During the final rule, as EPA develops recordkeeping and reporting requirements, EPA should ensure that they comply with all aspects of the Paperwork Reduction Act and 5 CFR 1320, including the requirements that the collection of information have practical utility (5 CFR 1320.9(a)) and that it reduce to the extent practicable and appropriate the burden on persons who shall provide information to the agency, including with respect to small entities (5 CFR 1320.9(c)).

This Information Collection Request (ICR) presents estimates of the burden and costs to the regulated community associated with implementation of the monitoring requirements of the Effluent Limitations Guidelines and Standards For The Construction and development Point Source Category (40 CFR Part 450). The guidelines require regulated operators to perform turbidity monitoring through the measurement and recording the levels of effluent nephelometric turbidity units (NTU).

The burden increase in question results from the development of effluent guidelines for construction sites, implemented through a requirement to control effluent turbidity. The burden change amount reflects EPA's estimate of the burden placed on affected sites to monitor and report their effluent turbidity to their control authorities following rain events during construction activities and the burden placed on control authorities (NPDES-authorized States) to follow up on these reports.
