Justification for No Material or Non-Substantive Change

OSM is seeking authority to merge the information collection authority for 1029-0128 into the collection authority for 1029-0036. We published the Excess Spoil final rule on December 12, 2008 (73 FR 75814). OMB reviewed and approved the collection for that rule and assigned it control number 1029-0128. That approved collection was only for the programmatic changes to 30 CFR 780.15, 780.25, 780.35, and for new section 30 CFR 780.28. Now, OSM is consolidating this new collection into the recently renewed collection for 1029-0036 (30 CFR Part 780).

For ease of review, and to maintain the historic information approved by OMB for 1029-0036, this supporting statement has not altered the discussion for those sections approved by OMB under 1029-0036, except for where the collection is merged and changed, namely, sections 780.15, 780.25, 780.28, and 780.35. In those sections we have incorporated the changes approved by OMB with approval of the Excess Spoil final rule and the approved collection 1029-0128.
