This interim rule makes amendments to the FDIC's rule on the Temporary Liquidity Program (TLGP)(12 CFR Part 370). Specifically, the interim rule expands the types of senior unsecured debt for which the FDIC will provide guarantees under the program to include mandatory convertible debt.
The FDIC is amending its Temporary Liquidity Guarantee Program to provide for a limited four-month extension to ensure an orderly transition from guaranteed to non-guaranteed funding for participating entities and to mitigate the potential for market disruption caused by the expiration of the program. The interim rule will take effect immediately and includes provisions for an application by participating entities to issue non-guaranteed debt that may be submitted after March 17.

The burden increase is the result of a limited four-month extension of the TLGP that requires written letter applications by participating entities to issue senior unsecured non-guaranteed debt after June 30, 2009, and by other participating entities that are neither insured depository institutions nor entities that have issued guaranteed debt under the program to issue FDIC-guaranteed after June 30, 2009, and on or before October 31, 2009.
