not an approval to conduct or sponsor an information collection
under the Paperwork Reduction Act of 1995 (PRA). This action has no
effect on any current approvals. If OMB has assigned this ICR a new
OMB Control Number, the OMB Control Number will not appear in the
active inventory. For future submissions of this information
collection, reference the OMB Control Number provided. In
accordance with the PRA and the terms of 5 CFR 1320, USDA is
required to display both the OMB Control Number and expiration date
associated with this collection, if approved. In addition, OMB
submits the following comment on this Information Collection
Request (ICR): This ICR is associated with a proposed rule that
would grant USDA authority to inspect catfish and catfish products.
OMB notes that FDA currently has authority for catfish inspection
and will continue to do so if this proposed rule is finalized. USDA
should consult with FDA about the requirements associated with this
ICR to determine which, if any, may be duplicative. At the time
this ICR is resubmitted, USDA should provide OMB with a table of
comparison to FDAs PRA requirements with respect to catfish. To
the extent that USDAs proposed requirements impose additional
burden when compared to FDAs, USDA should describe what the
practical utility and burden associated with those additional
requirements is expected to be. OMB notes that USDA proposes to
require plants to update their Sanitation Standard Operating
Procedures daily. USDA should describe the practical utility of
daily updates to this document, as opposed to more periodic
updates. OMB notes that USDAs proposed rule would require both
process controls and the establishment of HACCP plans. Since HACCP
plans are traditionally used as an alternative to more direct forms
of process controls, rather than as an additional measure, USDA
should describe the practical utility of these HACCP plans. OMB
notes that USDA proposes to require that all catfish products bear
product and nutrition labeling. USDA should provided quantified
information (if possible) on the practical utility of this labeling
and USDA's authority to require it. In its Supporting Statement,
USDA notes that conduct[ing] the information collections less
frequently will reduce the effectiveness of the catfish inspection
program. USDA should describe how less frequent collection of this
information will reduce the effectiveness of USDAs inspection
program and what consequences, if any, such reduced effectiveness
would have on the public.
