Legislation, giving FERC additional responsibilities, enhanced the CommissionÂs efforts to strengthen the reliability of the nation's interstate electric grid. The Electricity Modernization Act of 2005 was enacted into law (on 8/8/05) as part of the Energy Policy Act of 2005 (ÂEPAct 2005Â). Subtitle A of the Electricity Modernization Act amended the Federal Power Act (FPA) by adding a new section 215, titled ÂElectric Reliability. Section 215 of the FPA buttresses the CommissionÂs efforts to strengthen the reliability of the interstate grid through the grant of authority for a system of mandatory Reliability Standards developed by the Electric Reliability Organization (ERO)and reviewed and approved by FERC.
The figures for burden and cost have been revised, although the reporting requirements have not been changed. Because the program and requirements were at the preliminary stages, an applicant had not been selected to be the Electric Reliability Organization (ERO), and Regional Entities and Regional Advisory bodies had not yet been created, it was difficult at the initial clearance to estimate burden, the no. of respondents, responses, and cost. The ERO has been selected and the program established. Based on information from the ERO and staff, the previous burden and cost estimates (in the initial clearance, as well as the 60-day Notice related to this clearance request) have been revised.
