Abstract: The servicing agent agreement is executed by the borrower, certified development company and the loan servicing agent. The agreement is primarily used to certify use of loan proceeds, appoint a servicing agent and acknowledge the imposition of various fees.

Emergency Justfication: U.S. Small Business Administration is requesting approval on an emergency basis for certain 504 Loan Program forms affected by the American Recovery and Reinvestment Act of 2009 (ARRA) under Section 504 , Stimulus for Community Development Lending Low Interest Refinancing under Local Development Business Loan Program initiative. Additional justification information is contained in the attached letter from Eric Zarnikow, Associate Administrator for Capital Access
