A. Justification:
1. In accordance with 19 CFR 148.1(b), CBP Form 4457 (Certificate of Registration for Personal Effects Taken Abroad) is used by applicants for registration of articles of foreign origin, which are presented at the time of export, and must be signed in the presence of a CBP official after verification of description of articles is completed.
Form-4455 is used primarily for the registration, examination, and supervised lading of commercial shipments of articles exported for repair, alteration, processing, etc., which will subsequently be returned to the United States either free of duty or at a reduced rate. Forms 4457 and 4455 are used to provide the traveling public with a convenient means of showing proof of prior possession of a foreign‑made personal item taken on a trip abroad and later returned to the United States. CBP restricts this registration to articles with serial numbers or unique markings.
2. Travelers who do not have proof of prior possession in the U.S. of foreign‑made articles and who do not want to be assessed duty on these items, can register those items with serial numbers or unique markings. The traveler can present the registration form to the CBP officer upon reentry of the article as acceptable evidence of prior possession should a question arise concerning its dutiable status. Once an article is registered, the form can be used for more than one trip abroad.
3. Passengers must show this form to a CBP inspector at the border so they can bring their possessions (such as cameras) into the U.S. free of duty. So it would not be appropriate to submit this information electronically. These forms are on the CBP website.
4. There is no duplication of information.
5. The collection of information does not affect small businesses or entities.
6. There is no actual consequence to the federal program; however, the result would be the redundant collection of duties on articles that could have been entered in the U.S. free of duty.
7. This collection is not inconsistent with the guidelines of 5 CFR 1320.6
8. Public comments were solicited through two Federal Register notices published on April 9, 2009 (Volume 74, Pages 16226-16227) and on June 17, 2009 (Volume 74, Page 28711-28712). No comments were received.
9. There is no payment or gift to respondents.
10. No assurance of confidentiality is provided.
11. There are no questions of a sensitive nature.
12. Estimated Annualized Burden on The Public is 10,000 hours. The estimated number of respondents is 200,000 each filing one response. Each response requires an estimated .050 (3 minutes) for a total of 10,000 burden hours.
Estimated Annualized Cost on the Public. The estimated cost to the respondents is $140,000, based on an estimated 10,000 burden hours at an average cost of $14.00 per hour.

Public Cost
The estimated cost to the respondents is $280,000. This is based on the estimated burden hours (10,000) multiplied (x) hourly rate ($28.00).

There are no record keeping, capital, start-up or maintenance costs associated with this information collection.
14. Estimated Cost to the Federal Government:
The annual estimated cost to the Federal Government associated with reviewing and processing the information is $350,000. This is based on the time spent per response (3 minutes or .05 hours) x number of responses (200,000) = 10,000 hours expended x an annual rate of $35.00 = $350,000.
15. There has been no increase or decrease in the estimated annual burden hours previously reported for this information collection.
16. This collection of the information is not for statistical use.
17. CBP will display the expiration date for OMB approval of this information collection.
CBP does not request an exception to the certification of this information collection.
