Introduction
The American Recovery and Reinvestment Act of 2009 (Recovery Act), provides the State Departments of Transportation and Federal Lands Agencies with $27.5 billion for highway infrastructure investment. With these funds also comes an increased level of data reporting with the stated goal of improving transparency and accountability at all levels of government. According to President Obama, “Every American will be able to hold Washington accountable for these decisions by going online to see how and where their tax dollars are being spent.” The Federal Highway Administration (FHWA) in concert with the Office of the Secretary of Transportation (OST) and the other modes within the U.S. Department of Transportation (DOT) will be taking the appropriate steps to ensure that this accountability and transparency is in place for all infrastructure investments.
The reporting requirements of the Recovery Act are covered in Sections 1201 and 1512. Section 1201 (c)(1) stipulates that “notwithstanding any other provision of law each grant recipient shall submit to the covered agency (FHWA) from which they received funding periodic reports on the use of the funds appropriated in this Act for covered programs. Such reports shall be collected and compiled by the covered agency (FHWA) and transmitted to Congress. Covered agencies (FHWA) may develop such reports on behalf of grant recipients (states) to ensure the accuracy and consistency of such reports.”
OST, FRA, Federal Transit Administration (FTA), and Maritime Administration (MARAD) will initiate a data collection procedure in May 2009 called the TIGER Collector. Reporting on FHWA grants will continue to use the forms provided in this guidance. Recipients of non-FHWA funds will report on those non-FHWA funds using the TIGER Collector but continue to report on FHWA funds using the forms provided in this guidance.
Section 1512, or the “Jobs Accountability Act,” requires “any entity that receives recovery funds directly from the Federal Government (including recovery funds received through grant, loan, or contract) other than an individual,” including States, to provide regular ‘Recipient Reports’.”
All Prime Contractors must have or obtain a DUNS number. All US Government contractors, grantees and loan recipients can request a DUNS number or modification to an existing DUNS record by using the online webform process at http://fedgov.dnb.com/webform (for US and International locations) or they can call 866-705-5711, option 3. The toll free number is for US locations only, according to OMB Guidance.
Disadvantage Business Enterprise (DBE) information needs to be captured for each project. The data elements are for the project-specific DBE goal, prime contractor commitment at the time of award, and the actual dollars paid to the DBEs. The Recovery Act specifically states that the DBE requirements apply and the authority for data collection is grounded in the DBE regulations.
This document describes the reporting requirements and data analysis processes that FHWA will implement. States will be responsible for providing the data that are not currently available at the national level. Please note that this document does not address every data element that is required to be reported but rather the data that needs to be specifically collected because it is not currently being reported. To the maximum extent possible, FHWA will utilize existing data programs to meet the Recovery Act reporting requirements. For example, for the requirement to report aggregate expenditures of State funds, FHWA will use existing reports submitted by States and data collected in the Financial Management Information System (FMIS). The following diagram shows a conceptual overview of the flow of data between the existing data programs and the new data to be reported by the States, which will all be fed into a new FHWA data system for integrating, analyzing, and reporting the data. While the reporting obligations in the Recovery Act are only applicable to the grant recipients, the States may need to obtain certain information from their contractors, consultants, and other funding recipients in order to provide the FHWA with all of the required information.

As the recipients or grantees for the majority of the Recovery Act funds, States are by statute responsible for the reporting to FHWA on the projects, use of Recovery Act funds, and jobs supported. States that receive recovery fund apportionments directly from the Federal government are responsible for reporting to FHWA, which in turn is responsible for reporting periodically to Congress and quarterly to the Recovery.gov website. To achieve a high-quality and consistent basis for reporting, FHWA has designed a system for obtaining and summarizing data for all purposes. These purposes include ones in legislation and for providing a consistent platform for State and FHWA internal reports.
Reporting Timeline
FHWA will use the information from the regular, monthly State reports and existing FHWA data programs to meet the quarterly and periodic reporting requirements. FHWA requires monthly reporting of data from the States to ensure timely data verification and to ensure the data meets quality standards. In addition, employment data are required on a monthly basis for FHWA’s indirect and induced employment model. The following graphic shows when the various State and Federal Land Management Agency reports are due to the FHWA and when FHWA reports are due to Congress and the public.
Reporting
An initial list of projects to be funded with the Recovery Act, consistent with the list of projects provided in the State’s Section 1511 certification, will be submitted by the State directly to the FHWA Headquarters Office. Subsequent State reporting will be through the appropriate FHWA Division Office. The Division Office will be responsible for monitoring the compliance and completeness of the reports. The data quality reviews will be conducted by FHWA Headquarters Office. States will be responsible for updating the project status and jobs information monthly to their respective Division Office for all projects receiving Recovery Act funds. These monthly reports are required regardless of whether the project is funded in whole or in part by Recovery Act funds. To the maximum extent possible, States will be able to use existing State data programs for reporting. For States who do not currently have an existing system with the required information, FHWA will be providing MS Excel based forms that can be used for their own reporting as well as the reporting of their contractors, consultants, and other Recovery Act funding recipients.
It is important to point out that States are responsible for reporting project, jobs, and finance data for all Recovery Act projects including those managed by their funding recipients, such as other state agencies and local governments. States can utilize the FHWA forms for collecting this information, or can use their own existing or new systems if they so desire.
Initial Recovery Act Project Plan File Description
This section covers the by-project information to be provided by each State which accounts for how it plans to invest its allotment of Recovery Act funding. The list needs to be consistent with the list of projects provided in the State’s Section 1511 certification, as it may be amended. States should provide their best estimates of a complete list of projects to be funded with Recovery Act grants as of the plan’s due date. If a State has not programmed all Recovery Act funds by that time, that information should be provided as well. The project list should be provided in an electronic format that allows for data sorting. For the purpose of this initial project plan report, the State may provide the Section 1511 list of projects if that list of projects provides all data listed below. Simply referencing the STIP will likely not be sufficient, since most do not contain all of the required data. These data will be used for meeting the reporting requirements of Sections 1201 and 1512. The data are also used to link together State DOT and FHWA provided Recovery Act project data.
Format: The data should be provided as a comma separated variable (.csv) text file.
Due date: By March 31, 2009. The State shall provide an additional list of projects within 2 weeks of the State issuing a new Section 1511 certification until September 2012.

At a minimum, the recipient shall provide— (i) A brief description of the types of jobs created and jobs retained in the United States and outlying areas. ‘‘Jobs or positions created’’ means those new positions created and filled, or previously existing unfilled positions that are filled, as a result of Recovery Act funding. ‘‘Jobs or positions retained’’ means those previously existing filled positions that are retained as a result of Recovery Act funding. This description may rely on job titles, broader labor categories, or the contractor’s existing practice for describing jobs as long as the terms used are widely understood and describe the general nature of the work; and (ii) An estimate of the number of jobs created and jobs retained in the United States and outlying areas. At a minimum, this estimate shall include any new positions created and any existing filled positions that were retained to support or carry out Recovery Act projects or activities managed directly by the recipient, and if known, by subrecipients. The number shall be expressed as ‘‘full-time equivalent’’ (FTE), calculated cumulatively as all hours worked divided by the total number of hours in a full-time schedule, as defined by the recipient. For instance, two full-time employees and one part-time employee working half days would be reported as 2.5 FTE in each calendar quarter. (iii) A job cannot be reported as both created and retained. As used in this instruction, United States means the 50 States and the District of Columbia, and outlying areas means— (1) Commonwealths. (i) Puerto Rico. (ii) The Northern Mariana Islands; (2) Territories. (i) American Samoa. (ii) Guam. (iii) U.S. Virgin Islands; and (3) Minor outlying islands. (i) Baker Island. (ii) Howland Island. The state will provide information for the five most highly compensated officers of the entity. The names and total compensation of the five most highly compensated officers of the subrecipient entity will be reported if: (1) the recipient in its preceding fiscal year received (a) 80 percent or more of its annual gross revenues in Federal awards; and (b) $25,000,000 or more in annual gross revenues from Federal awards; and (2) the public does not have access to information about the compensation of the senior executives of the entity through periodic reports filed under section 13(a) or 15(d) of the Securities Exchange Act of 1934 (15 U.S.C. 78m(a), 78o(d)) or section 6104 of the Internal Revenue Code of 1986 [26 USC § 6104].
‘‘Total compensation’’ means the cash and non-cash dollar value earned by the executive during the subrecipient’s past fiscal year and includes of the following: (i) salary and bonus; (ii) awards of stock, stock options, and stock appreciation rights (Use the dollar amount recognized for financial statement reporting purposes with respect to the fiscal year in accordance with FAS 123R); (iii) earnings for services under non-equity incentive plans (Does not include group life, health, hospitalization, or medical reimbursement plans that do not discriminate in favor of executives and are available generally to all salaried employees); (iv) change in pension value (This is the change in present value of defined benefit and actuarial pension plans.); (v) above-market earnings on deferred compensation that are not tax-qualified; and (vi) other compensation (For example: severance, termination payments, value of life insurance paid on behalf of the employee, perquisites or property if the value for the executive exceeds $10,000). Maintenance of Effort
As with the 1201 planned expenditure certifications, the reports are for expenditures of State funds on the various types of projects funded under the Recovery Act (not obligations or encumbrances). The 1201 Maintenance of Effort Actual Expenditures Report also must include any State funds spent on projects that are not receiving Recovery Act funding, such as State-funded match for federally-assisted projects and State funding for non-federally-assisted projects that are eligible for Federal funding. This data will be compared to amounts included in the State’s MOE certification that will ultimately be used to determine whether each State met its level of effort during the covered period (February 17, 2009, through September 30, 2010).
States must report actual expenditures from State sources for the types of projects funded by each of the covered programs. States must complete the form for all program areas listed in the document, not just “Highway Infrastructure Investment.”

Construction on approximate alignment of an existing route where the old pavement structure is substantially removed and replaced. Such reconstruction includes widening to provide continuous additional through-lane(s), adding or revising interchanges, or replacing other highway elements such as a grade separation to replace an existing grade intersection. Also included, where necessary, are other incidental improvements such as drainage and shoulder improvements. |

4R Reconstruction, No Added Capacity |
Widening the lanes and/or shoulders of an existing roadway without adding through lanes. This may include reconstructing the existing pavement and other incidental improvements such as shoulder and drainage improvements. |

4R Resurfacing |
Placement of additional surface material over the existing roadway to improve serviceability or to provide additional strength. There may be some upgrading of unsafe features and other incidental work in conjunction with resurfacing. 4R Restoration and Rehabilitation |
