Proposed Rule entitled: 10 CFR Part 31, "Limiting the Quantity of Byproduct Material in a Generally Licensed Device." The NRC is proposing to amend its regulations to limit the amount of certain byproduct material in a generally licensed device to below 1/10 of the IAEA Category 3 thresholds. The proposed amendment would require licensees possessing devices meeting or exceeding these thresholds to submit an application for a specific license. The NRC and/or the Agreement States would review such applications and issue licenses as appropriate.

This proposed rule will impose an additional information collection burden of 31,114 hours to the existing burden requirements for 10 CFR Parts 19, 20, and 30, with some reduction of burdens under Part 31. The increased burden will result from the limitation of generally licensed devices to those with sources less than 1/10th of IAEA Category 3. Approximately 1,400 current general licensees (280 NRC licensees and 1,120 Agreement State licensees) will be affected by this rule by having to become specific licensees and follow the requirements of these existing Parts in NRC and equivalent Agreement State regulations. The information is needed to improve the accountability and control certain existing generally licensed devices with radioactive sources above the limit in this proposed amendment. The changes for 10 CFR Part 31 (3150-0016) requires a decrease of 370 burden hrs and an decrease of 22,180 respondents and 34,925 responses. In addition, the cost for professional effort has been increased from $157 to $238 per hour.
