Abstract: The Notice of Proposed Rulemaking proposes to modify the existing Hazard Communication Standard to make it consistent with the most recent version of the Globally Harmonized System. The proposal involves changing the criteria for classifying health and physical hazards, adopting standardized labeling requirements, and requiring a standardized order of information for safety sheets.

Short Statement: The proposed rulemaking would result in an annualized increase of 708,471 hours (see Item 12 of this supporting statement) and $10,685,086 (see Item 13 of the supporting statement. The increase in burden hours and costs is associated with reclassifying chemicals, changing all safety data sheets to conform to the new regulation, and updating all labels and conversion to new software. Employers will have to gather data on hazards and other characteristics of their chemicals, apply the GHS criteria to determine the hazard categories, establish a uniform system for revising existing Safety Data Sheets and labels and make the necessary revisions. This burden will be removed in the future as employers complete reclassification of chemicals, modifying data sheets and labels.
