FERC amended its regulations to add a new Subpart (Subpart H of Part 35, 18 CFR) governing market-based rates for public utilities in accordance with the Federal Power Act(FPA). FERC codified and, in certain respects, revised its current standards for market-based rates for sales of electric energy, capacity, and ancillary services. FERC retained several of the core elements of its current standards for granting market-based rates and revising them in certain respects. FERC also streamlined aspects of its filing requirements to reduce the administrative burdens on applicants, customers and on FERC. In RM10-20-000 (NOPR) FERC is amending its regulations governing market based rates for public utilities to reflect a clarification that the separation of functions and information sharing provisions of the market-based rate affiliate restrictions prohibit the sharing of employees who determine the timing of scheduled outages or who engage in economic dispatch, fuel procurement or resource planning.
