This collection of information is
required by 35 U.S.C. Sec. 2(b)(2)(D) and 32. The Office of
Enrollment and Discipline (OED) collects this information to insure
compliance with the USPTO Code of Professional Responsibility 37
CFR 10.20-10.112, which describes how attorneys or practitioners
should conduct themselves professionally and outlines their
responsibilities for record keeping and reporting violations or
complaints of misconduct to the USPTO, and with the investigations
and Disciplinary Proceedings rules 37 CFR 10.130-10.170, which
outline how the USPTO can discipline attorneys and
practitioners.
The increase in the responses,
burden hours, and annual cost burden for this collection is due to
administrative adjustments. The USPTO expects the number of
responses for this collection to increase by 103, from 532 to 635
per year and that the burden hours will increase by 1,928, from
10,402 to 12,330 hours per year. The USPTO estimates that the total
annual (non-hour) cost burden for this collection will increase by
$400, from $87 to $487 per year. This is due not only to increased
submissions, but also to an increased postage rate and a
recalculation of the weight of the responses.
