Rulemaking Not Required
The new grant program for ANTAP is not subject to rulemaking requirements because it is a limited program not of general application and future effect, but rather will request specific proposals from the public and USDA will determination which proposals will receive grants. In the event that this program should be repeated it will have to be determined whether the provisions should be, because of that repetition, considered a rule prospectively for that repetition.
