Section 563 of the Homeland Security Appropriations Act of 2008 – the Secure Handling of Ammonium Nitrate Act – provides DHS with authority to regulate the sale and transfer of ammonium nitrate. This collection will enable the Department to "regulate the sale and transfer of ammonium nitrate by an ammonium nitrate facility . . . to prevent the misappropriation or use of ammonium nitrate in an act of terrorism." See Pub. L. 110-161.
