RE: Request for OMB Approval for Emergency Processing
Dear Ms. Mar:
Thank you for taking the time to review our application and request on such short notice. We have been working diligently with OMB through the past months to prepare the documents enabling the Segal Education Award transfer provisions of the Edward M Kennedy Serve America Act, PL 111-13 (the “Serve America Act”). We appreciate your time and attention to expediting the clearance of this collection.
As you know, The Corporation for National and Community Service (the “Corporation”) has amended several provisions relating to the operation of the National Service Trust through the final rule published on August 20, 2010, which implement provisions of the Serve America Act (42 USC 12501). One of these provisions authorizes AmeriCorps members to transfer all or a part of an education award, and limits who can transfer an award and who can receive the transferred award. In an effort to be compliant with the newly enacted provisions, we are therefore submitting the enclosed request under 5 CFR 1320.13 to OMB for emergency processing and approval of information collection activities.
Public harm is reasonably likely to occur if normal clearance procedures are followed. It is essential to the mission of the Corporation that AmeriCorps members may avail themselves of the ability to transfer all or a portion of their education awards to qualified individuals at the earliest possible moment, as we are mandated to do. Adding an extra four months to go through the regular OMB approval process will cause undue hardship and public harm as qualified AmeriCorps members will not be able to manage the use of their award in a timely manner. In sum, we are requesting emergency approval by November 18, 2010 for a period of six months.
The Corporation has not learned of any objections to the content of this submission from interested parties in previous communication about these collection activities. Because we were diligent in eliciting public comment during the rulemaking, we expect little substantive comment when we request a response for 60 days of comment, as you have suggested.
This submission consists of four instruments entitled Request to Transfer a Segal Education Award Amount Form, Accept/Decline Award Transfer Form, Request to Revoke Transfer of Education Award Form, and Rescind Acceptance of Award Transfer Form. It also includes this letter, OMB Form 83-I, the Certification for Paperwork Reduction Act Submission, Supporting Justification, a copy of the Federal Register notice, and a copy of the relevant statute.
Since September 11, 2001, and the President’s Call to Service, many Americans have expressed a renewed desire to serve their country by volunteering in their community. Now, we have an obligation to ensure that, having served, AmeriCorps members have full use of their education award, as mandated. Moreover, as the Corporation and OMB have previously communicated, the Corporation is working hard to ensure it is fully compliant with the Paperwork Reduction Act and with OMB’s information collection policies and procedures.
