Justification of 83-C Submission Affecting the Notice of Denial of Medical Coverage (NDMC) and Notice of Denial of Payment (NDP) Collection Instruments



OMB has previously approved English and Spanish versions of the Notice of Denial of Medical Coverage (NDMC) and the Notice of Denial of Payment (NDP) – OMB approval number 0938-0829. This submission is intended to comport with the recently revised version of CMS-10003. These are exact translations of the English versions of these notices. The translations are nonmaterial changes and do not alter the purpose, meaning, or use of the NDMC or NDP.


Note that the Part C denial notices are translated into Spanish, but the instructions are not. It is unnecessary to translate the instructions, because the instructions are not provided to the Medicare beneficiary (Part C plan enrollee). The Part C plan enrollee will receive the denial notice if the plan denies coverage or payment, but the enrollee will not receive the instructions. Again, the instructions are for use by the Part C plan in completing the denial notice sent to the enrollee if the plan denies coverage or payment for a service.
