Revision to the Collection Instrument:


Change 1: We are eliminating sections in 20 CFR 405 pertaining to the Disability Review Board and reinstating Appeals Council review for those States affected by 20 CFR part 405. Most of the collections will continue under 20 CFR Parts 404, 405, and 416. The chart below includes the comparable citations from 20 CFR Parts 404, 405, and 416 of the Code of Federal Regulations:

Justification 1: SSA is removing certain sections of 20 CFR 405 because the agency decided to eliminate the Decision Review Board under 20 CFR 405. We will allow claimants who are dissatisfied with the decision they receive at the hearing level, or for whom an administrative law judge (ALJ) dismisses their requests for hearing, the opportunity to request that the Appeals Council review the hearing level decision.


Change 2: Addition of a Code of Federal Regulations section, 405.401, not previously covered under approved OMB control numbers:


Justification 2: SSA is eliminating the Decision Review Board under 20 CFR 405 in favor of allowing claimants who receive unfavorable decisions from the ALJ hearing level to request review by the Appeals Council. Section 405.401 explains procedures for requesting review of a hearing decision or a dismissal of a hearing request and the conditions under which the Appeals Council will consider new evidence. We kept some of the processes, such as the Quick Disability Determinations (QDD), which was previously, moved to 20 CFR parts 404 and 416.


Change 3: SSA is adding comparable sections from 20 CFR parts 404 and 416 as appropriate within the clearance request.


Justification 3: This will ensure that OMB approves all related reporting requirements.


Change 4: SSA is adding sections from 20 CFR 405 as part of the amendments to the final rule for RIN 0960-AG80. We show these additional citations in #12 of the Supporting Statement.


Justification 4: We did not previously add these sections to this information collection request. However, since there are no forms or applications associated with these rules we are adding them now.
