Under 18 USC 922, ATF requires firearms licensees to contact the National Instant Criminal Background Check System (NICS) for a background check before transferring any firearms to unlicensed individuals. The purpose is to prevent convicted felons and other prohibited persons from purchasing firearms from licensed firearms dealers.
