Summary of Changes to CMS-R-131


The Advance Beneficiary Notice of Noncoverage (ABN) is a liability notice delivered to beneficiaries, when required, by Part B paid physicians, providers, practitioners, and suppliers, as well as Part A paid hospice providers and religious non-medical health care institutions. The ABN underwent revision with the 2008 PRA submission; however, with this submission, changes are minimal and nonsubstantive to comply with Section 508 of the Rehabilitation Act of 1973, as amended in 1998, which requires Federal agencies to ensure that information us accessible to the general public.


This package incorporates minor formatting revisions to the form and the instructions to better comply with 508 accessibility requirements. No further substantive changes have been made.


The following nonsubstantive changes have been made to the form:


  • Parentheses surrounding alphabetical labeling of parts of the notice have been removed to facilitate accessibility access with reading options.

  • Minor changes in line and paragraph formatting were made to comply with 508 accessibility reading options.



The following nonsubstantive changes have been made to the instructions:


  • Minor changes were made in line and paragraph formatting to comply with 508 accessibility reading options.


The ABN is an existing collection and is in use. It is our expectation that the nonsubstantive changes to the form and instructions will have little effect on burden for all users.


Burden is expected to decrease for providers using the ABN based on the following:


  • The availability of a 508 compliant form for accessibility will prevent providers and institutions from having to invest their own work and financial resources to create an accessible document.
