Terms of Clearance: DEA will submit a major revision to this form in the immediate future as part of its rulemaking on the disposal of controlled substances. DEA will address DEA Form 41 changes in detail in the NPRM preamble, the Paperwork Reduction Act analysis, and the regulatory text. If DEA does not submit a major revision to this form during this new clearance period, the agency will: • Insert a blank line between the signature box and the registrant’s DEA number on pg. 1 of the form; • Insert a short statement—“If you destroyed any controlled substance, please provide the following:”—above the DATE line on pg. 2 of the form; • Reduce the number of copies associated with the form.

Abstract: Title 21, CFR, 1307.21 requires that any registrant desiring to voluntarily dispose of controlled substances shall list these controlled substances on DEA Form 41 and submit the form to the nearest DEA office. The DEA 41 is used to account for destroyed controlled substances, and its use is mandatory.
