Abstract: The OPM is issuing this RFI to gather information related to our requirement to contract with health insurance issuers under section 1334 of the Affordable Care Act. The goal of the RFI is to better understand potential offerors' interests and capabilities. The RFI also provides background information on the statutory requirements for Multi-State Plans.

Emergency Justfication: This is to request emergency clearance for the Request for Information (RFI), Multi-State Plans. The Office of Personnel Management (OPM) is requesting emergency clearance for this RFI in order to complete the agency’s statutory requirements under the Patient Protection and Affordable Care Act of 2010 (Pub. L. 111-148 and Pub. L. 111-152, collectively referred to as the Affordable Care Act or the Act). Section 1334 of the Affordable Care Act directs OPM to contract with health insurance issuers to offer multi-State qualified health plans through State health insurance exchanges (Exchanges). OPM is required to contract with at least two multi-State qualified health plans (Multi-State Plans) that will offer health insurance coverage for purchase to individuals and small employers through Exchanges beginning in 2014. OPM is issuing the RFI to gather information related to our requirement to contract with health insurance issuers. The goal of the RFI is to better understand potential offerors’ interests and capabilities. The RFI poses specific questions to aid us in the development of our procurement documents. In order to draft the required procurement documents, OPM needs information from industry. OPM must complete the procurement documents within the next year in order to complete the contracting process to meet the Affordable Care Act’s statutory deadline. Use of a normal clearance procedure will delay the collection of information to the extent that OPM would not be able to timely draft the required procurement documents within the next year. OPM has consulted with the Department of Health and Human Services, Center for Consumer Information and Insurance Oversight, and other agencies involved in the implementation of health reform to gather information and draft this request in order to minimize the burden on the public. OMB should approve the information within 10 days.
