The 1998 Public Housing Reform Act allowed the mixed-finance development of public housing units. This meant that Public Housing Authorities (PHAs) could create public housing projects using public housing capital funds and outside sources of funds, subject to HUD's approval. This Information Collection pertains to the information that HUD collects in order to approve the mixed-finance development of public housing prior to a financial closing and the start of construction or rehabilitation activities. Applicants describe ownership, the type, size, and number of units, construction schedule, construction and permanent financing, property management, how public housing operating subsidy will be provided to the project and other operation plans.
This ICR is a revision to ICR 201012-2577-002, which was rejected by OMB on June 7, 2011, due to a burden-hour conflict between the Supporting Document text and ROCIS. The ICR includes documents that; are required under the existing §§941.6, are required under the proposed §§941.6, and that are required under both versions of §§941.6. Details can be found in the Supplementary Document, "Matrix for Streamlining Rule 8-17-11.xlsx" ("Matrix"), which was requested by OMB during the review of the rejected ICR.
One ICR document, Mixed-finance Evidentiaries, was included in OMB 2577-0033 until that Control Number was combined with 12 other Control Numbers and consolidated under the existing 2577-0157, which covered all Public Housing Capital Fund collections. At that point, it was accidentally not included in the consolidation and no longer had an OMB Control Number. The reinstatement of "Mixed-Finance Evidentiaries" is being added to the original ICR through this revision and represents the Third-Party documents that are being submitted to HUD under the current §§941.600, and that will be retained by the respondents under the proposed §§941.600. Since the definition of this ICR document has changed slightly, its reinstatement is included as a Program Change.
Eight other Mixed-Finance ICR documents were previously included in OMB 2577-0157. In consultation with HUD's Office of the Chief Information Officer, the existing Mixed-Finance documents were removed from 2577-0157 via NOA dated 1/31/2011. Six of these were included in the original, rejected ICR and the other two are being added through this revision. Burden hours for these eight ICR documents were subtracted from OMB 2577-0157 when they were removed and currently have no OMB Control Number. The burden hours are being added through reinstatement of those ICR documents as Program Changes. Details can be found in Question #15 and in the Matrix.
Program Changes:
The definition of ICR document #1, Mixed-Finance Evidentiaries,has been changed since it was last covered by an OMB Control Number. It used to include all of the ICR documents that were included in the original ICR, except for forms HUD-50029 and HUD-50030.
ICR documents# 2 and 3, are new collections that will be required under the proposed Rule.
ICR document #4 is the set of certifications and assurances that are submitted to HUD in accordance with the current §§941.6. They used to be included in the Evidentiaries ICR document that was under 2577-0033. They have now been broken out, since the new definition of "Mixed-Finance Evidentiaries" only includes Third-Party Evidentiaries.
Adjustments:
The total increase in burden hours due to Program Changes is 9,923 hours at a cost of $1,798,125.
The total increase in burden hours due to Adjustments is 1,645 hours at a cost of $143,375.
The total increase in burden hours is 11,568 at a cost of $1,941,500.
