Under the Natural Gas Act(NGA) a
natural gas company must obtain FERC authorization to engage in the
transportation, sale or exchange of natural gas in interstate
commerce. However, Section 7(c) of the NGA exempts from certificate
requirements "temporary acts or operations for which issuance of a
certificate will not be required in the public interest." An
emergency is defined as any situation in which actual or expected
shortage of gas supply would require an interstate pipeline
company, intrastate pipeline, local distribution company, or
Hinshaw pipeline to curtail deliveries of gas or provide less than
the projected level of service to any customer. A sudden
unanticipated loss of natural gas supply or suddent unanticipated
increase in demand or any situation in which the participant, in
good faith, determines that immediat action is required for the
protection of life or health or the maintenance of physical
property are also emergencies.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
