Memo to OMB concerning the instrument for 1820-NEW

The instrument is basically the regulations that are now being cleared. Within them you will note that

#1 Free and low cost services must be explained to parents when they request this information after a state adopts Part B due process procedures.

#2 List of mediators must be maintains by each state LA. These individuals may serve as hearing officers, and their qualifications should be maintained.

#3 List of hearing officers. Each public agency in a state that adopts Part B due process procedures must maintain a list of individuals who are capable of serving as hearing officers.

#4 State complaint procedures. Each LA must adopt written procedures for receiving and resolving complaints filed by any party that alleges that the LA or an early intervention service provider is violating a Part C statutory or regulatory requirement.
