with 5 CFR 1320, the information collection is preapproved. We note
that this collection is associated with a final rule. As part of
the terms of clearance for this collection, OMB requests NRC to
update the collection with the Federal Register citation
information once the final rule has been published in the Federal
Register. In addition, OMB requests NRC to transfer the burden from
this collection to the 10 CFR Part 73 collection (OMB Control
Number: 3150-0002) and then discontinue this new collection.

The U. S. Nuclear Regulatory
Commission (NRC) is amending its regulations that govern packaging
and transportation of radioactive material and physical protection
of plants and materials. Specifically, the amendments require
licensees to provide advance notification to participating
Federally-recognized Tribal governments regarding shipments of
irradiated reactor fuel and certain nuclear wastes for any shipment
that passes within or across their reservations. The rule extends
to Tribal officials, his or her designee, and Tribal law
enforcement personnel relief from fingerprinting requirements
required for access to Safeguards Information (SGI). The
participating Tribal government is required to protect the shipment
information as SGI.
The final rule will increase
the recordkeeping and third party notification requirements in Part
73 by 163 hours from 524,820 to 524,983 because this is a new
requirement to notify participating Tribes of shipments that cross
Tribal reservations. All of the burden is associated with Part 73;
there is no expected increase for Part 71. Upon approval of this
Final Rule, the Burden for 10 CFR Part 73 will be transfered to its
correct clearance 3150-0002. The total annual burden for this
proposed rule is 163 hours (6.4 recordkeeping hours + 156.4 third
party hours). The total annualized burden cost for this proposed
rule is $41,891 (163 hours x $257/hr).
