The Bureau of Consumer Financial Protection (CFPB) respectfully requests emergency processing and approval of the collection of information discussed below because the use of normal clearance procedures is reasonably likely to prevent and disrupt an existing collection of information. Perpetrators of frauds against distressed homeowners and members of the military with judgments against them often stealthily move across state lines to set-up similar scams in surrounding states, resulting in a need for a mechanism to more easily identify these repeat offenders by state and federal law enforcement. The information collected will be used by state and federal law enforcement to identify repeat offenders of frauds against distressed homeowners and members of the military. The voluntary respondents may consist of state attorneys general, and other state agencies.
The CFPB is requesting approval of a new OMB control number for these collection activities to comply with section 1021 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (PL 111-203). Section 1029A states that this subtitle shall become effective on the designated transfer date. To prevent disruption of an approved information collection, the CFPB is requesting emergency processing and approval of the following information collection request. Upon receipt of emergency approval from the Office of Management and Budget, the CFPB will begin a standard approval process for this collection and will seek public input at that time.

This is a new collection effort assigned to the CFPB activities to comply with section 1021 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (PL 111-203). The Bureau will evaluate the initial estimates once there is appropriate data collected and a better understanding of the participation rate by the respondents. The initial estimate of burden is 150 responses and 150 hours per year.
