Abstract: The Discharge Application: Total and Permanent Disability serves as the means by which an individual who is totally and permanently disabled, as defined in §437(a)(1) of the Higher Education Act of 1965, as amended, applies for discharge of his or her Direct Loan, Federal Family Education Loan (FFEL), or Perkins loan program loans, or the Teacher Education Assistance for College and Higher Education (TEACH) grant service obligation. The form collects the information that is needed by the U.S. Department of Education to determine the individual's eligibility for discharge based on total and permanent disability.

Short Statement: The final regulations require loan holders to refer borrowers requesting a total and permanent disability (TPD) discharge for a Perkins Loan or a Federal Family Education Loan to the Department. Those loan holders will no longer provide the TPD application, nor receive the completed and submitted applications, review and evaluate the TPD applications, nor make a preliminary determination as to whether the application supports the conclusion that the borrower is totally and permanently disabled.
