This Part implements the requirements in Section 701(28) of the Surface Mining Control and Reclamation Act of 1977 (SMCRA), P.L. 95-87, which grants an exemption from the requirements of SMCRA to operators extracting not more than 16 2/3 percentage tonnage of coal incidental to the extraction of other minerals. This information will be used by the regulatory authorities to make that determination.

OSM is requesting the continued authority to collect information for 30 CFR Part 702. This collection request will reduce the burden by 51 hours, and non-wage costs by $600. This is primarily due to adjustments in the number of new respondents who submit applications for coal mining exemptions. This reduction is offset by an increase in respondents who are actively mining under the exemption and are required to submit annual reports.
